ARBITRATION LAW

Arbitration law in the United Arab Emirates (UAE) is governed by Federal Law No. 6 of 2018 concerning Arbitration (the "Arbitration Law"). The Arbitration Law is based on the UNCITRAL Model Law on International Commercial Arbitration, and provides a comprehensive legal framework for the conduct of arbitral proceedings in the UAE.

Under the Arbitration Law, parties to a dispute may choose to resolve their dispute through arbitration, either by agreement or by referral from a court. The Arbitration Law applies to both domestic and international arbitration, and provides for the recognition and enforcement of foreign arbitral awards in the UAE.

One of the key features of the Arbitration Law is its emphasis on party autonomy, which allows the parties to agree on the procedures that will be followed in the arbitral proceedings, including the choice of arbitrators, the rules of procedure, and the seat of the arbitration. The Arbitration Law also provides for the appointment of arbitrators in the absence of an agreement between the parties, and sets out the grounds for challenge and disqualification of arbitrators.

In terms of the enforcement of arbitral awards, the Arbitration Law provides that awards rendered in the UAE will be recognized and enforced in the country, subject to limited grounds for setting aside or refusal of recognition and enforcement. The Arbitration Law also provides for the recognition and enforcement of foreign arbitral awards in the UAE, in accordance with the provisions of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.

Overall, the Arbitration Law provides a modern and effective framework for the resolution of disputes through arbitration in the UAE, and is recognized as one of the most advanced arbitration laws in the region. If you are involved in a dispute and considering arbitration as a means of resolving it, it is advisable to seek the advice of a qualified legal expert to ensure that your rights and interests are protected.
