    Arbitration Law

Arbitration is a legal process by which two parties consensually engage in discussions to find a mutually beneficial and satisfactory resolution. This method provides several benefits compared to litigation, as it is a private dispute resolution strategy rather than a public. Most importantly, it is a much quicker method of dispute resolution, the by-product of which means it is also significantly more affordable for the involved parties.

At ESQ, you will find the best Arbitration Lawyers in Dubai in many arbitration courts, including the Abu Dhabi Commercial Conciliation and Arbitration Center (ADCCAC), Rules of Dubai International Arbitration Center (DIAC), and even the International Court of Arbitration (ICC), to name but a few.

Working closely with clients in total transparency and integrity enables us to provide these services and avoid more costly procedures such as litigation. Whether a settlement is reached or not, we are well-placed to act on your behalf in providing counsel and legal advice.

    Civil Law

Civil Law is enacted at the federal level in Dubai and the wider UAE. However, laws also vary between each of the emirates. These devolved powers mean civil laws differ depending on location. Different cities and areas in the country require slightly different approaches and areas of expertise.

At ESQ, we offer a wealth of knowledge and skill, effectively navigating the nuances behind civil Law, whether among private individuals or disputes between individuals and organizations. Civil Law differs from criminal Law in that it deals with non-criminal charges such as not paying rent or breaking a contract. Civil Law mainly deals with issues related to rental agreements, collecting debt, warrants and negligence. Civil Law typically has interests in landlord and tenancy agreements, debt collection, contracts, or corporate negligence.

    Criminal Law

Criminal Law is the field relevant to illegal activity, with a stronger emphasis on punitive and rehabilitative verdicts instead of solely compensatory resolutions. In the UAE and Dubai, Criminal Law is part of the federal system based on Islamic Sharia law. In severe cases, the physical or death penalty may be used as a deterrent against criminal behaviour. To determine criminal charges, one must prove actus reus (guilty act) and men’s rea (guilty mind); to prosecute a criminal charge, there must be evidence of both criminal action and criminal intent.

As one of the best legal practices in Dubai and the UAE, we have a proven track record of successful criminal cases with great expertise and knowledge of Islamic Sharia Law and UAE federal law. We operate in a highly confidential and professional manner, working closely with clients to ensure fair representation. Our multi-lingual team has extensive experience in international legal systems; we are well-equipped to take on cases involving foreign nationals alongside our work with UAE citizens and residents.

Whether in Dubai or the wider UAE, our law firm provides a full range of criminal law representation services. This includes reliable advice from the first instances of police investigation to prosecution and up to court appearances and appeals.
