Punishment for assault according to UAE law:

According to the UAE Penal Code No. 31 of 2021, the penalty for assault varies depending on the material and moral damage that may be caused to the victim, and depending on the circumstances surrounding the perpetrator.

The penalties are as follows:

First: According to Article No. 387, whoever assaults another person’s physical safety by any means, whether by hand, stick, foot, or other means, without intending to kill him, but this assault results in the victim’s death, shall be punished by temporary imprisonment for a period not exceeding 10 years. 

Second: Anyone who assaults another person’s physical safety by any means, whether by hand, stick, foot, or other means, and the result of this assault is a permanent disability without his intention to cause it, shall be punished by imprisonment for a period not exceeding 5 years, in accordance with Article 389 of this law.

Third: The penalty shall be temporary imprisonment for a period not exceeding 10 years if the assault was carried out with complete premeditation and deliberation, or occurred against a relative, or if the assault occurred against a public employee due to his job, and if the victim was under the influence of alcohol or drugs.

Fourth: Anyone who assaults the physical safety of another person and this assault results in his illness or inability to perform his personal work for a period not exceeding 20 days shall be punished with imprisonment and a fine. The penalty shall be imprisonment for a period not exceeding one year and a fine not exceeding 10,000 dirhams, if the result of the assault does not reach the degree of seriousness. If the assault on a pregnant woman results in a miscarriage, the law considers this an aggravating circumstance, as stipulated in Article No. 390 of the law.

Legal procedures in the case of assault:

If you are assaulted by someone and you want to file a complaint, you must first submit a claim memorandum to the criminal court by seeking the assistance of a lawyer specialised in these cases, so that you can appoint him to represent you before the court. The claim memorandum must include all the necessary information that must be mentioned according to what is stated in the UAE Criminal Procedure Law, which is as follows:

1. Name of the criminal court to which the case is brought.

2. Claimant's data.

3. Defendant's data.

4. Subject of the lawsuit.

5. The facts of the case, which include an explanation of how the crime occurred.

6. Include legal evidence to support the claim.
